Expect a permit for anything bigger than a 50 sq ft storage closet, a pad in the side or rear yard, and anchors cast to the shed maker's drawing.

Sort this out before the shed slab goes anywhere. Every one of the 4,003 Property Appraiser parcels sitting wholly inside the Cypress Gardens CDP lists Winter Haven as its property city. Yet on Polk County's city-limits map layer, no part of the CDP falls inside a city. That puts your shed permit with the Polk County Building Division, not the city's building desk, and the filing goes through the county's Accela portal.

The trap is right across the road. LEGOLAND Florida, built on the old Cypress Gardens park property, sits inside Winter Haven city limits, and the house lots across the street from it are county lots. House first, side or rear yard: Polk's Sec. 209 for a storage shed

Polk's Land Development Code Sec. 209 covers backyard storage buildings across unincorporated Polk, and every Cypress Gardens lot falls under it. Four of its lines decide where your concrete can go:

  • The building permit comes before construction of any accessory structure.
  • A permitted principal use, which on a house lot means the house, has to exist already. A vacant lot can't take a shed first.
  • The shed goes in the side or rear yard.
  • It stays out of any required buffer, the minimum accessory setback, the right-of-way and any easement, unless the easement holder approves.

Your setback distance depends on your parcel's land use district. Ask the county for your number and get it in writing before we stake the forms. The Sec. 209 text is on Municode if you want to read it. Polk's permitting page also lists slabs built to support a structure as permit work. The only storage it leaves off is a prefab closet no taller than 5 feet mean height, no bigger than 50 square feet or 250 cubic feet, with no power or plumbing. An 8 by 10 kit is already past that 50 square foot cap.

Lake Summit, Lake Ina and Lake Roy lots: the road-split rule and flood zones

The 2020 Census boundary of Cypress Gardens takes in Lake Summit, Lake Ina, Lake Roy, Lake Doll, Lake Florence and Lake Ned. The Property Appraiser codes 255 parcels here as residential lakefront and 53 more as other waterfront homes. On some lake lots a public road cuts the parcel in two, with the house on one side and the shoreline on the other. Sec. 209.D.5 lets a dock, boat cover, gazebo or pergola go on that lakeside piece without a house, as long as it meets setbacks. A storage shed isn't on the list, so it belongs on the house side of the road.

Flood maps count on these lots too. At 77 points sampled across the CDP on FEMA's National Flood Hazard Layer, 70.1% fell in Zone X and 27.3% in Zone AE. Polk's flood section, LDC Sec. 630, puts a building's lowest floor, along with its mechanical, plumbing and electrical equipment, at least 1 foot above base flood elevation. Under Polk LDC Sec. 630.N.6, a one-story detached storage building of 600 sq ft or less may sit at grade in a flood zone when it has flood openings, so ask the county if your shed qualifies. The City of Winter Haven next door asks for 2 feet, so don't go by a city neighbor's numbers. If your yard is in an AE zone, ask the county how Sec. 630 treats a storage shed before we set the pad height.

Candler sand in most yards, muck where the lawn meets the water

Across a 77-point sample of NRCS soil mapping in the community, taken from the state's SSURGO soil layer, Candler-Urban land complex, 0 to 5% slopes, sits under 42.9% of the points. Candler is excessively drained sand, and NRCS rates it not limited for buildings without basements. Add Tavares, Apopka, Zolfo and a few others with the same rating, and about 56% of the points land on that kind of ground.

Now the other side. About 23% of the points sit on poorly or very poorly drained units rated very limited, Kaliga muck, Hontoon muck and Pomona among them. The mucks turn up near lake edges, and organic soil there needs a geotechnical look before a slab goes on it. On every pad we strip the grass, roots and topsoil inside the forms, as Florida's residential code requires, and then compact the base. If a low corner needs raising, the same code caps fill under a slab at 24 inches of clean sand or gravel unless the building official approves more. Check your lot on the NRCS Web Soil Survey before you pick a corner of the yard.

Pad size, tie-downs and one saw cut on a 12x16 storage building

Work from the shed maker's foundation drawing, not the size on the brochure. Every wall needs full bearing on concrete, and the anchors go exactly where the drawing puts them. Florida law exempts storage sheds of 720 square feet or less from the wind-borne debris impact standards. That exemption doesn't touch wind load or anchoring. The design wind speed comes from the Florida Building Code wind maps by risk category and goes on the maker's or engineer's drawing, and we cast the anchor bolts or straps to that sheet.

Florida's residential code sets a 3 1/2 inch minimum for a slab on ground, and residential slabs typically run about 4 inches. If a car, trailer or heavy machine will live inside, tell us, and the drawing sets the number. For joints, NRMCA spaces them 24 to 36 times the thickness, which gives a 4 inch pad panels of 8 to 12 feet. A 12 by 16 pad takes one cut across the middle and ends up as two 12 by 8 panels. The code also lets a slab skip joints if it carries synthetic fiber or 6x6 welded wire in the middle to upper third. A shed counts as an unheated accessory building, so the vapor retarder rule has an exception for it, unless the soil was treated for termites. Treated soil always gets 6-mil poly over it.

Farm storage, bigger shops and the Garden Grove overlay

Florida's farm-building law lists a storage building among the nonresidential farm buildings it can exempt from the building code. The land has to be an integral part of a farm operation or classified agricultural, and the building has to be used mainly for agriculture. Cypress Gardens is mostly house lots: 3,113 single-family parcels of up to 2.49 acres and 262 condominium parcels. A shed on one of those lots is an accessory building under Sec. 209. Has the plan grown from a shed into a workshop? Check the size before you order. Sec. 209.G lets an accessory building be larger than the house without a variance only on lots of 2 acres or more. What size pad goes under a 12x16 shed in a Cypress Gardens yard?
Go by the shed maker's foundation drawing, not the 12x16 label. Every wall needs full bearing on concrete and the anchors sit where that drawing places them, so we size the pad to the drawing's footprint and form it square and level. On a tight lot keep the margin modest, since every inch of slab still has to clear your accessory setback and any easement.
Will my Cypress Gardens shed stay put on its slab in a hurricane?
The slab holds the anchors and the anchors hold the shed, so the tie-down design does the work. Wind speed comes from the Florida Building Code wind maps for the building's risk category and goes on the maker's or engineer's drawing. We cast the anchors to that sheet. Sheds of 720 square feet or less skip the debris impact standards, never the wind load.
Can I put a storage shed on the lake side of the road on my Cypress Gardens lot?
No. Where a public road splits a waterfront lot, Polk's Sec. 209.D.5 lets docks, boat covers, gazebos and pergolas go on the lakeside portion without the house, if they meet setbacks. Storage buildings aren't on that list. Put the shed and its pad on the house side of the road, in the side or rear yard.
My Cypress Gardens address says Winter Haven. Do I file the shed permit with the city?
Most likely not. Every parcel wholly inside the Cypress Gardens CDP lists Winter Haven as its property city, but Polk County's city-limits layer puts the whole CDP outside every city. That means the Polk County Building Division permits the shed. LEGOLAND, across the road, is inside city limits, so check your own parcel on the county map before you apply.
Is the ground near Lake Ned or Lake Florence okay for a shed slab?
That depends on how close to the water you build. Candler sand, the most common soil in the community, is excessively drained, and NRCS rates it not limited for buildings without basements. Near the water, NRCS mapping shows muck soils like Kaliga and Hontoon, and organic soil like that needs a geotechnical look before a slab goes down. If your spot is low or soft underfoot, we'll tell you at the site walk and price the base work separately.
Do I need a house on the lot before a shed slab in Cypress Gardens?
Yes. Polk's Sec. 209 requires a permitted principal use on the lot before any accessory structure is built, and on a residential lot that's the house. Agricultural structures are the exception. A vacant lot can't take the shed slab first. Building both at once? Ask the Polk County Building Division how to sequence the two permits before you book the pour.
